CVRA By-Trustee Area Election Process

Here is the first set of proposed maps for the new trustee areas. These four different options will be considered during the Public Hearing at the Board Meeting on Thursday, April 14, 2022.

 

Updated on April 20, 2022! Based on the feedback from the Board Meeting on Thursday, April 14th, three new sets of maps have been created - Blue B, Green B and Green C. These maps, along with the original maps, will be considered during the Public Hearing at the Special Board Meeting on Wednesday, April 27, 2022.

April 21st, 2022:

Ukiah Unified Trustees to review new election maps on April 27

On March 10, 2022, the Ukiah Unified School District Board of Trustees adopted Resolution No. 11, 2021-22, declaring the District's intention to transition to by-trustee area elections.  Public hearings were held on March 10 and March 24, 2022, where Trustees requested community input regarding the preparation of potential trustee area maps.  After these public hearings, a demographer prepared maps based on the legal requirements of the Federal Voting Rights Act, the California Voting Rights Act, and community input. These initial maps were made available to the public on April 1, 2022.  

 

On April 14, 2022, the Ukiah Unified Trustees held the first of two public hearings regarding the maps themselves.  Based on the input from the April 14 meeting, maps have been revised and made available to the public at www.uusd.net. Trustees will hold a second public hearing on Wednesday, April 27, 2022, at 5:00 p.m. to discuss and vote on revised maps.

 

“We are nearing the end of the process for our move to by-trustee area elections, and the public has one more chance to weigh in on the new maps. We have had several meetings and public hearings to develop these maps, and I believe they are well balanced and provide a variety of options to choose from,” said Ukiah Unified Chief Business Official Steve Barekman. “We will be reviewing three final options and voting on maps at our next meeting on April 27th. March 24th, 2022:

Ukiah Unified Trustees Vote to Remain at Seven Members and Give Direction on Trustee-Area Map Creation

On March 24th, the Ukiah Unified Trustees engaged in a special meeting and public hearing to discuss the potential movement from seven members to five and to give direction on map creation for their transition to by-trustee area elections to meet the requirements under the California Voter Rights Act (CVRA).  The CVRA requires that trustees be elected by those living in their trustee area and not by an at-large system, as has been the case in Ukiah Unified for decades. In a 4-2 vote, the Trustees decided to keep its membership at seven.


After hearing input at the March 24 meeting, proposed maps prepared by King Consulting, a company the District has contracted to provide demographic studies, will be available to the public at www.uusd.net on Friday, April 1, 2022. These maps will be discussed in a Public Hearing on April 14, 2022. After that meeting, maps will be revised and made available by April 20, 2022, and there will be an additional public hearing on April 27, 2022.

Background:

The Ukiah Unified School District is currently elected using an “at-large” election system, meaning that governing board members must live in defined trustee areas, but are elected by voters of the entire District.  On March 10, 2022, the Trustees adopted Resolution No. 11, 2021-22, declaring its intent to transition to by-trustee area elections.

March 10th, 2022:

Ukiah Unified Trustees Vote Unanimously for Move to By-Trustee Area Elections

To ensure compliance with The California Voting Rights Act, Ukiah Unified Trustees voted to move to a by-trustee area election system. View Resolution No. 11, 2021-22 Ukiah Unified trustee Intent to Transition from at-large to by-trustee area elections. The California Voting Rights Act (CVRA) took effect January 1, 2003, and prohibits the use of an at-large election system if it can be shown that such an election system results in racially polarized voting. In other words, it is prohibited to use an at-large election system that impairs the ability of a protected class to elect candidates of its choice or its ability to influence the outcome of an election. (Elections Code § 14027.) 


Using an at-large election system puts school districts at risk of litigation and legal fees. Proof of intent to discriminate is not required for a CVRA violation, and except for one case currently pending, no public entity has successfully defended against a CVRA claim.
