Protecting Our Students and Families
California has established strong protections to ensure that all students – regardless of immigration status – feel safe at school. Two state laws, Senate Bill 98 and Senate Bill 49, outline clear requirements for how school districts must respond if federal immigration agents (ICE) seek access to school property or student information.
What the Laws Require
Senate Bill 98
SB 98 reinforces schools as safe places for students and families. It requires districts to have policies that protect student records and personal information and mandates that immigration enforcement activity comply with all federal and state law. Importantly, SB 98 also requires school districts to notify staff, students, parents/guardians, and the broader school community when the presence of immigration enforcement agents on or near a school campus is confirmed, to the extent allowed by law. The notification must provide general information about the encounter and available resources, without disclosing any private or identifying details.
Senate Bill 49
SB 49 goes further by prohibiting school staff from granting access to school grounds or confidential student data to immigration enforcement officers without a valid judicial warrant. Schools must also notify the superintendent and legal counsel before responding to any such request.
