Title IX - Sex-Based Discrimination is Prohibited

The Title IX information provided here applies to every school site and to all District programs and activities.

 

What Are My Rights Under Title IX?

  • You have the right to fair and equitable treatment, and you shall not be discriminated against based on your sex.
  • You have the right to be provided with an equitable opportunity to participate in all academic extracurricular activities, including athletics.
  • You have the right to inquire of the athletic director of your school or appropriate District personnel as to the athletic opportunities offered by the school.
  • You have the right to apply for athletic scholarships if the District offers any.
  • You have the right to receive equitable treatment and benefits in the provision of all of the following related to athletics, if any are provided by the District:

o   Equipment and supplies;

o   Scheduling of games and practices;

o   Transportation and daily allowances;

o   Access to tutoring;

o   Coaching;

o   Locker rooms

o   Practice and competitive facilities;

o   Medical and training facilities and services; and 

o   Publicity

  • You have the right to have access to a gender equity coordinator, referred to as the Title IX Coordinator, to answer questions regarding gender equity laws.
  • You have the right to contact the State Department of Education and the California Interscholastic Federation to access information on sex/gender equity laws.
  • You have the right to file a confidential discrimination complaint with the United States Department of Education Office for Civil Rights or the California Department of Education if you believe you have been discriminated against or if you believe you have received unequal treatment on the basis of your sex.
  • You have the right to pursue civil remedies if you have been discriminated against.
  • You have the right to be protected against retaliation if you file a discrimination complaint. (California Education Code § 221.8.)

What Are The District’s Responsibilities under Title IX?

If the District has actual knowledge of sexual harassment in a district program or activity, it must respond reasonably in light of the known circumstances. The District must equitably resolve sexual harassment complaints in accordance with its complaint procedures.

Who Is The Title IX Coordinator?

The District designates the following individual as the responsible employee to coordinate its efforts to comply with Title IX of the Education Amendments of 1972 in accordance with the its Title IX Sexual Harassment Complaint Procedures.

How Do I File A Title IX Complaint?

A formal Title IX complaint, with the complainant’s physical or digital signature, may be filed with the Title IX Coordinator in person, by mail, by email.  (34 CFR 106.30).

 

Even if the Complainant chooses not to file a formal complaint, the Title IX Coordinator may sign a formal complaint in situations when a safety threat exists and in other situations as permitted under Title IX, including as part of the district’s obligation to not be deliberately indifferent to known allegations of Title IX sexual harassment.  In such cases, the Title IX Coordinator is not a party to the formal complaint.  The Title IX Coordinator will provide notices to the complainant as required by Title IX.

 

The district may consolidate formal complaints of Title IX sexual harassment against more than one respondent, or by more than one complainant, or by one party against another, where the allegations of Title IX sexual harassment arise out of the same facts or circumstances. 

 

 

When Must A Title IX Complaint Be Filed?

There is no statute of limitation for when a complainant can report sexual harassment under Title IX, but the district may dismiss a complaint if it is unable to identify the respondent after taking reasonable steps to do so, or the respondent is not participating in the district's education program or activity and is not employed by the district. 

 

Regardless of whether a complainant complies with the writing, timeline, and/or other formal filing requirements, all complaints alleging unlawful discrimination, including discriminatory harassment, intimidation, or bullying, shall be carefully examined and prompt action taken to stop the discrimination, prevent recurrence, and address any continuing effect on students.

 

Filing a Title IX Complaint with OCR:

Either party has the right to file a complaint with the U.S. Department of Education, Office for Civil Rights, within 180 days of the date of the most recently alleged misconduct.  If the complaint involves matters that occurred longer ago than this, a complainant may request a waiver from OCR by providing an explanation as to why the complaint was delayed.

How will a Title IX complaint be investigated?

Title IX complaints will be investigated in accordance with AR 4119.12/4219.12/4319.12 and AR 5145.71, Title IX Sexual Harassment Complaint Procedures, as applicable. [IM1]
